XRP Lawsuit: The Ripple Community Prepares for Potential SEC Settlement Discussions

Every new development in the ongoing legal battle between the U.S. Securities and Exchange Commission (SEC) and Ripple Labs has the cryptocurrency community on the edge of their seats with expectation. The XRP community has been discussing the possibility of a settlement in this historic dispute after a recent order from the court. Before the pretrial session on April 16, 2024, presiding Judge Analisa Torres has mandated a face-to-face settlement conference between the parties. The court ordered the attorneys to “meet in person for at least one hour to discuss the settlement of this matter.” The question that remains is whether or not this will lead to a conclusion.

Prospects for the Ripple Case

Partner at Hogan & Hogan Law Firm and cryptocurrency expert Jeremy Hogan recently dissected the odds of alternative outcomes in the case. Hogan identifies three main possibilities:

• The SEC advances its case against individual defendants in court (39.456% chance): Hogan observes that if the SEC were to pursue this course of action, a definitive resolution would not be reached until 2027, rendering it an exceedingly unattractive alternative.

• Hogan believes that if the SEC settles with individual defendants and obtains a Final Judgment against Ripple (32.113% chance), this could potentially resolve the case by August 2026 and would be the most efficient method for the SEC to reach an appellate court.

• All litigation against Ripple and individual defendants is settled by the SEC (18.987% chance): Although considered the least probable scenario by Hogan, this course of action would benefit both Ripple and the SEC, granting the SEC an additional advantage and permitting the company to progress.

Hogan has also designated a probable resolution date of December 21, 2023. Even though the likelihood is less than 20%, the XRP community is buzzing with excitement at the prospect.

Speculations from the Community

The XRP community has been full with speculation outside of Hogan’s expert opinion. Even though Ripple is in a stronger position, influencer Jenny Q thinks a resolution may not be possible. And now there are whispers that the SEC and Ripple are already in settlement talks, adding insult to injury.

The conclusion of this case may or may not have implications for the future of cryptocurrency regulation in the United States. The SEC’s overzealous approach to digital assets has been criticized, and a loss could cause it to change its strategy in future cases.
